sub: Final Order Under Sections 11(1), 11(4) and 11B of the Securities and Exchange Board of India Act, 1992, in the Matter of Vibgyor Allied Industries Ltd(VAIL) In respect of Mr. Tapas Kumar Basu (PAN - ADLPB2640K).
Attention of the trading members is invited to the Exchange Notice No. 20180309-43 dated 09th March 2018 wherein SEBI, vide its Order no. WTM/GM/IMD/ 98 /2017–18 dated March 9, 2018 had inter-alia directed that VAIL and its directors along with the Debenture Trustees to not access the securities market or buy, sell or otherwise deal in the securities market, either directly or indirectly, or associate themselves as directors with any listed Company or Company intending to raise money from the public.
SEBI, now vide its Order no. WTM/AB/EFD-1/DRA-4/10/ 2018-19 dated December 20, 2018 has inter-alia directed that the Noticee viz.Mr Tapas Kumar Basu (ADLPB2640K) is prohibited from accessing the securities market or buy, sell or otherwise deal in the securities market, either directly or indirectly, for a period of four years. It is, further, clarified that the existing holding of securities of the Noticees, including the units of mutual funds, shall remain frozen during the period of restraint.
Further, it is also mentioned in the said SEBI Order that the Noticee vide SEBI Order dated March 09, 2018, was restrained from accessing the securities market and buying, selling or dealing in securities, either directly or indirectly, in any manner whatsoever until further orders. Hence, the prohibition already undergone by the Noticee, pursuant to aforementioned SEBI Order dated March 09, 2018 shall be adjusted while computing the period in respect of prohibition imposed vide this Order.
This Order shall come into force w.e.f. December 21, 2018.
