Sub: Order under Sections 11(1), 11(4), 11A and 11B of the Securities and Exchange Board of India Act, 1992 in the matter of GMS Infrastructure Limited. (GMS)
SEBI, vide its Order no. WTM/GM/IMD/93/2017–18 dated February 23, 2018 has inter-alia issued the following directions:
- Directed GMS (PAN : AAECG0030B) and its Directors/Promoters, viz. Ashim Mitra (PAN : AKDPM2024K); Sanjoy Mitra; Lopamudra Bandyapadhyay (PAN : AQFPB2001D); Biswajit Das (PAN : AMPPD6913J); Dinesh Chowhan (PAN : ANDPC7427M); Chandan Biswas (PAN : ALIPB5094L); Rajesh Singh (PAN : CLKPS6324N); Tumpa Mitra Dutta (PAN : BAKPD5407K); Shib Shankar Ghosh(PAN : ATKPG5933F); Soumen Paul (PAN : BEEPP5894Q); Aparna Roy Chowdhury(PAN : AHOPR4164P); Mina Mukherjee (PAN : ATQPM8850R); Gita Karmakar and GMS Multi Marketing Services Pvt. Limited (presently known as ADH Food Products Pvt. Limited) (PAN : AADCG6529L) shall not access the securities market or buy, sell or otherwise deal in the securities market, either directly or indirectly, or associate themselves with any listed company or company intending to raise money from the public.
· Further as stated in the aforesaid order, in the event of the Noticees failing to file replies or requesting for an opportunity of personal hearing within 90 days from the date of receipt of the order, the preliminary findings as mentioned in the aforsaid Order shall become final and absolute against the respective Noticees automatically, without any further orders. Consequently, the Noticees shall automatically be bound by the directions contained in paragraphs 4.2(i)–(ii) till the expiry of a period of four years from the date of repayment to the satisfaction of SEBI.
This Order shall come into force with immediate effect, which shall remain in force till further orders.

Trading members are advised to take note of the same and ensure compliance.
