Sub: Final order under Sections 11, 11(4), 11A and 11B of the Securities and Exchange Board of India Act, 1992 in the matter of Vaastav ALR International Limited (VAIL)
Attention of the trading members is invited to the Exchange Notice No.20151012-16 dated October 12, 2015, wherein SEBI vide its Order no. WTM/SR/SEBI-ERO/166/10/2015 dated October 09, 2015 had inter-alia restrained the entities viz. Vaastav ALR International Limited and its directors from accessing the securities market and further prohibited from buying, selling or otherwise dealing in with the securities market, directly or indirectly till further direction.
SEBI, now vide its Order no. WTM/MPB/FED-1-DRA-IV/41/2018 dated September 12, 2018 has inter-alia directed VAIL, Shri Bappaditya Mukherjee, Shri Atish Samanta Ray, Shri Netai Pramanik, Shri Anup Kumar Maiti, Shri Dibyendu Sekhar Maity, Shri Shilajit Ghosh and Shri Dilip Jana not to, directly or indirectly, access the securities market, by issuing prospectus, offer document or advertisement soliciting money from the public and are further restrained and prohibited from buying, selling or otherwise dealing in the securities market, directly or indirectly in whatsoever manner, from the date of this Order, till the expiry of 4 (four) years from the date of completion of refunds to investors as directed in the aforesaid Order.
Restrained Vaastav Debenture Trust and Shri Chinmoy Ghatak from accessing the securities market and are further restrained from buying, selling or dealing in securities, in any manner whatsoever, for a period of 4 (four) years from the date of this order.
Further, it is also stated in the aforesaid Order that the directions against Shri Atish Samanta is made contingent on SEBI taking steps to ascertain the fact of whether Shri Atish Samanta is alive and serving this order to the legal representatives of the Shri Atish Samanta, in case Shri Atish Samanta is not alive.
This Order is effective from 12th September, 2018.
